Board & Tribunals

Our members of the National Pensions Board, Labour Tribunal, and Labour Appeals Tribunal bring a wealth of knowledge and experience to enhance the Labour and Pensions framework that aligns to its national legislation.

While the terms of appointments approved by Cabinet will vary for the Board and Tribunals, members remain committed to serve in their roles to fulfill the purpose of serving to improve the legal and/or operational infrastructure to make the lives of those that use its services better. The National Pensions Board is responsible for hearing, considering and determining decisions appealed in accordance with the National Pensions Act; promoting the establishment, extension and improvement of pension plans throughout the Islands; advising the Minister in respect of the business of the Board; and making recommendations to the Minister in respect of pension plans.

The Labour Tribunal, and the Labour Appeals Tribunal are responsible for hearing, cross-examining, and adjudicating labour claims of Severance Pay and Unfair Dismissal complaints received from employees against their former employers and making decisions on requests for the waivers of overtime benefits in accordance with the Labour Act and Labour Tribunal Regulations.

National Pensions Board

The National Pensions Board is established under the National Pensions Act (2024 Revision) and has the following duties:

(a) hear, consider and determine decisions appealed in accordance with Part XIII of the Act;
(b) promote the establishment, extension and improvement of pension plans throughout the Islands;
(c) advise the Minister in respect of the business of the Board; and
(d) make recommendations to the Minister in respect of pension plans.
 

The Director serves as the Chief Administrative Officer of the National Pensions Board and shall exercise the powers and perform the duties that are vested in or imposed upon the Director by the National Pensions Act.

 

The Board is appointed by Cabinet and in accordance with the National Pensions Act, the Board shall consist of a Chairperson, a Deputy Chairperson and such other members being not less than five nor more than nine.

Labour Tribunal

The Labour Tribunal is a quasi-judicial body established for the purpose of adjudicating labour claims from employees against their former employers. As an independent body that is separate from the Department of Labour & Pensions, its remit is limited to the claims of Severance Pay and Unfair Dismissal complaints, and requests for the waiver of overtime benefits as stipulated under the Labour Act and Labour Tribunal Regulations.
 
This tribunal is selected from a panel of persons appointed by the Cabinet. The panel comprises of a Chairperson, Deputy Chairperson and Members appointed for a period not exceeding two (2) years from the date of appointment. Each panel is responsible for conducting fair and impartial hearings, reviewing evidential material and applying the relevant sections in the legislation as per the Labour Act (2021 Revision) in order for a legally reasoned decision within the statutory timeframe to be made.

Contrary to popular belief, this tribunal does not function like a Board, but rather it considers oral and written evidence submitted by both parties who are also granted the right to call witnesses, cross examine and give closing arguments. It is upon this record that the Tribunal proceeds to make a reasoned decision.

Labour Appeals Tribunal

The Labour Appeals Tribunal is the higher quasi-judicial independent body also established for the purpose of adjudicating labour claims in the form of Severance Pay, Unfair Dismissal, and Overtime Waivers appealed from the Labour Tribunal to the Labour Appeals Tribunal. These appealed claims follow the guidance in accordance with the Labour Act and Labour Regulations.

This tribunal is selected from a panel of persons appointed by the Cabinet. The panel comprises of a maximum of nine (9) members, of which consists of a Chairperson, and could consist of Deputy Chairperson(s) and Members appointed for a period of one (1) year from the date of appointment. Like the Labour Tribunal, each panel is responsible for conducting fair and impartial hearings, reviewing evidential material and applying the relevant sections in the legislation as per the Labour Act (2021 Revision) in order for a legally reasoned decision within the statutory timeframe is made.
